En 1987,  la CHG decidió deslindar el tramo del río Guadiana que comprende el paraje natural de los Ojos del Guadiana, en los términos municipales ciudadrealeños de Daimiel y Villarrubia de los Ojos, ante la proliferación de empresas y particulares que habían abierto pozos ilegales y se dedicaban a extraer el carbón de turba de la zona.
Este deslinde fue recurrido por tres particulares a los que el Tribunal Superior de Justicia de Extremadura dió la razón en 1990, porque consideraba que esta franja de terreno no formaba parte del río y, por tanto, no era de propiedad pública.
El recurso interpuesto por la Abogacía del Estado ante el Tribunal Supremo acabó revocando el fallo del Tribunal Superior de Justicia extremeño y consideró que los Ojos del Guadiana, tanto si era considerado río,  laguna o una zona mixta de río y laguna, conformaban un lecho de agua que debía ser de dominio público puesto que «los ríos y las lagunas lo son».Tampoco la circunstancia de que no hubiera agua «no cambia la conclusión anterior».
En Enero del 2014,la CHG  empezó el proceso de deslinde del río Guadiana en el tramo que va desde los Ojos del Guadiana al entorno del molino de Zuacorta. Este proceso se culmina en Mayo del 2016,con la recuperación de la titularidad de pleno dominio de todas las fincas rústicas incluidas en el deslinde de ambas márgenes del río Guadiana, por inmatriculación, definida así por el propio Ministerio, en el tramo comprendido entre la carretera Daimiel-Villarrubia de los Ojos y Manzanares-Villarrubia de los Ojos, abarcando una superficie total de 348,94 hectáreas,de las que 174,51 hectáreas se localizan en el término municipal de Villarrubia de los Ojos y 174,43 en el de Daimiel.

Una vez deslindado este tramo, se comenzó con la incoación del procedimiento para deslindar el tramo del río desde Zuacorta hasta su confluencia con el Parque Nacional de las Tablas de Daimiel.Es aquí donde surge el verdadero conflicto, pues las fincas afectadas corresponden a diferentes personas que las explotan fundamentalmente en actividades agrícolas  y defienden su propiedad alegando que la titularidad de estas fincas está reconocida en el catastro, «en algunos casos desde principios del siglo XX», como recalcaba  Jesús Pozuelo, presidente de los regantes daimieleños y uno de los agricultores afectados por este deslinde en declaraciones a Radio Daimiel.
Ayer aumentaba la tensión del conflicto. Según nota informativa de Radio Daimiel (Daimiel.es),técnicos de la Confederación Hidrográfica del Guadiana  empezaron el martes dia 10 a delimitar sobre el terreno la recuperación de Dominio Público Hidráulico, en el tramo del río Guadiana entre los molinos de Zuacorta y Molemocho, en el margen izquierdo del río y esperando que se prolonguen unos días más hasta cubrir los 13,5 kilómetros del tramo afectado.

Ante esta situación los afectados presentaron unas primeras alegaciones que no han sido estimadas y anunciaban en palabras de Jesús Pozuelo»el conflicto acaba de empezar, las espadas siguen en alto».
